On February 2012, an amendment to the Charitable and Non-Profit Gaming Act 1999 commenced as a result of the Charitable and Non-Profit Gaming (Two-up) Amendment Act 2012.
This amendment allows for two-up to be played legally in a licensed RSL or Services club on Anzac Day, or another day that is significant to the remembrance of the sacrifice for the nation by the men and women of its Defence Force and is prescribed under a regulation.
Conducting two-up
Two-up can be played and conducted on Anzac Day (and other designated days), with certain provisions applicable for non-RSL licensees.
Note: People aged under 18 must not play two-up.
RSL and Service Clubs
RSL and Services Clubs do not need to seek permission from any regulatory authority to play two-up on Anzac Day, or other designated days.
Other licensed venues
If approved in writing by an RSL sub-branch, other licensed premises can also conduct two-up on their premises as part of an official function for Anzac Day or another designated day.
Monies collected and wagered for two-up
Under the Amendment Act no commission can be charged on money wagered.
All money wagered in the game must be returned to players as winnings.
If an entry fee is charged for those who participate in the game, the money raised is to be donated to the RSL or RSL sub-branch to support ex-service men and women and their families. The money raised from entry fees should not be used for administrative purposes.
